The Platform also includes all of the subdomains and any other media operated by PGF Programme (UK) Ltd (“us”, “our”, “we”). This document sets out the terms for use of the Platform and governs all users (“Users“, “you”). In addition to the educational content provided, there are other features that may be offered to the Users. By using our Platform in any manner you are expressly agreeing to, and give your consent to be governed by, these Terms. If you do not agree with these Terms or you do not wish to be bound by these Terms, you must not use or access the Platform or the Services in any manner. Users assume full responsibility for the disclosure and use of any other personal information the User chooses to disclose on the Platform. 2. Terms Applicable to All Users of the Platform The following applies to all Users at any time you access and use the Platform. (a) Age of Access You must be at least 18 years old to use the Platform and its Services. If you are under the age of 18 you may not use our Platform in any manner nor may you register for an account. (b) License to Users We grant you a limited, non-exclusive license to access and use the Platform for your own personal educational purposes. This license is only for your use and may not be assigned or sublicensed to anyone else, without our express written consent. Except as expressly permitted by us in writing, you will not attempt to reproduce the Platform or any content included on it (this includes any activity that would reproduce, redistribute, sell, create derivative works from, decompile, reverse engineer, or disassemble the Platform). You also agree that in exchange for this license you will not engage in any activity that would interfere with or damage or harm the Platform. (c) Code of Conduct Our Code of Conduct includes No Illegal Activity: Do not use the Platform for any illegal activity. You are not allowed to use our Platform to engage in any kind of conduct that violates any applicable law or regulation (including, without limitation, any laws regarding the export of data or software to and from the UK). No Bad Code: Do not use the Platform to transmit, distribute, send, or otherwise expose the Platform or its Users to viruses, worms, or any other code that may be deemed dangerous, harmful, or destructive in any manner. No Spamming: You may not use the Platform to engage in any activities that will result in sending spam to anyone on the Platform, including PGF Programme (UK) Ltd (and its employees) and other Users. No Exploitation: You will not use the Platform to try to gather personal information on any other Users. No Impersonation: You will not impersonate anyone on the Platform, including PGF Programme (UK) Ltd (and its employees) or any other person or entity. No Data Mining or Bots: You may not use any data mining, robots, or similar data gathering or extraction methods. No Use Other Than Intended: You may not use the Platform or any Content contained on the Platform for any purposes other than intended. This includes attempting to pitch to other Users for work. No Prohibited Content: You must not post any content that contains material that is libelous, slanderous, pornographic, obscene, unlawful, threatening, hateful, violent, predatory, defamatory, or otherwise objectionable, all of which shall be determined in PGF Programme (UK) Ltd’s sole discretion. If you violate this Code of Conduct, we reserve the right to remove you and any of the content you may post from the Platform. Whether conduct violates our Code of Conduct will be determined in PGF Programme (UK) Ltd‘s sole discretion. 3. PGF Programme (UK) Ltd’s General Rights In Operating Its Platform PGF Programme (UK) Ltd reserves the following rights over the Platform, namely we: may modify, terminate, or refuse to provide Services at any time for any reason, without notice. may remove anyone from the Platform at any time for any reason, solely in its discretion. This right is not modified by any other section of this Agreement. reserves the right to access your account in order to respond to requests for technical support, to maintain the safety and security of the Platform, and for other legitimate business purposes, as necessary, in its discretion. may, but has no obligation to, monitor any content that appears on the Platform or review any conduct occurring through the Platform, including any interactions between Users and our employees. reserves the right to modify, suspend, or alter its refund policy, at its sole discretion. may keep a copy of your content if you close your account. Third Party Offerings Through the Platform, you will have the ability to access content, links to websites, and services provided by the authors of the Platform and other third parties (“Third Party Offerings“). Your use of any Third Party Offerings provided on this Platform or a third party website is at your own risk. We do not monitor or have any control over, and makes no claim or representation regarding Third Party Offerings and accepts no responsibility for reviewing changes or updates to, or the quality, content, policies, nature or reliability of, Third Party Offerings. You should review applicable terms and policies, including privacy and data gathering practices, of any third party, and should make whatever investigation you feel necessary or appropriate before proceeding with any transaction with any third party. 6. Payments To access the Services, you must pay a one-off registration fee (”Registration Fee”). The Registration Fee may vary from time to time and be changed by PGF Programme (UK) Ltd without any warning. Once you pay the Registration Fee, you will be able to access the Services for three months. To continue to access the Services, you must pay a subscription fee every three months (“Subscription Fee”). The Subscription Fee will automatically be debited from the same bank account that you provide us when you pay the Registration Fee. Should we be unable to process the Subscription Fee at any time, you will lose access to the Services. If you believe we have withdrawn your access to the Services by mistake, please contact us. 7. Account Ownership Once you register, you are not entitled to share your account details or the Services with any other person or entity outside of your immediate family. Immediate family includes your children and spouse only. Should you share the your account or the Services with anyone other than your immediate family, we reserve the right to immediately cancel your account without paying any refund to any fee you have paid PGF Programme (UK) Ltd. You agree to keep all information on the Platform and included with the Services confidential. 8. Refund Policy You may receive a refund of the Registration Fee if you request such a refund within 48 hours of the Registration Fee clearing in our bank account. You are not entitled to any refund of the Subscription Fee. 9. Cancellation of your Account If you cancel your account, the cancellation will become effective at the end of the then-current billing cycle. When the cancellation becomes effective you will not be able to access any of the Services. You may restart your account and payment of the Subscription Fee at any time. 10. Errors and Corrections We do not guarantee that the Platform or any services offered through the Platform will be error-free or otherwise reliable, nor do we guarantee that defects will be corrected or that any offerings through the Platform will always be accessible. We may make improvements and/or changes to the Platform and their features and functionality at any time, and will use commercially reasonable efforts to avoid disrupting peak hours, though some downtime may occur. We reserve the right to amend the Platform, and any service or material we provide on the Platform, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Platform is unavailable at any time or for any period. From time to time, we may restrict access to some or all of the Platform to Users. 11.
